Phillips CPAP Machine Recall Facts & History

On June 14, 2021, Philips Respironics - a subsidiary of the Dutch conglomerate Koninklijke Philips, N.V. "Royal Philips" - issued a recall for several different breathing machines. The recalled Philips CPAP machines are most commonly sold under the brand name "DreamStation." The remaining 20% were ventilators that provided a backup in hospital settings when the patient could not breathe on their own.

The defective sound abatement foam in these machines risks degrading and releasing toxic particles or chemicals. The company is recalling devices sold between 2009 and April 2021.

Philips has been aware of the dangers associated with their sound abatement foam for some time, and yet they continued to produce machines that would inevitably harm people. The first warnings about this potential risk were not issued until April 2021, but it appears Philips knew or should have known about these problems earlier than that. Users of CPAP machines reported finding black debris in masks tubing and having several health issues related to the use of such products.


Litigation has just begun, and there are potentially hundreds of thousands of plaintiffs across America. It's expected that a federal MDL will exist, which expedites pretrial proceedings by temporarily consolidating all personal injury cases during such proceedings.



  • June:
    • A proposed class-action suit was filed against Koninklijke Philips NV in federal court. The lawsuit was Shelton v. Koninklijke Philips N.V., et al. The case claims defendants knew well before recalling that some of their CPAP devices contained PE-PUR sound abatement foam that could degrade and enter into the machines' air pathways or off-gas chemicals. The lawsuit aims to cover anyone in the U.S. who purchased one of the recalled Philips devices anytime from the beginning of the applicable statute of limitations period through June 14, 2021.
    • A series of class-action cases, including Manna v. Koninklijke Philips N.V., et al., Boudreau v. Philips North America, et al., and Hufnus v. Koninklijke Philips N.V., et al., were pending in Massachusetts.
    • There were ten lawsuits filed in U.S. District Court in Boston since June 17. Among the most serious allegations made, Philips failed to disclose the defect as soon as it knew about it.
