Plaintiff Allegations:

Plaintiffs allege that paraquat products contribute to the development of Parkinson's disease after exposure. People who have handled herbicides allege that the manufacturer is liable for defective design and failure to warn consumers about the neurological risks that may result from regularly handling weed and grass killers.

History:

2025:

  • October (scheduled): The first bellwether trial is scheduled on October 14, 2025. The second trial will take place in 2026.
  • June: Plaintiffs and defendants are expected to give an update on a potential settlement agreement by June 11, 2025.
  • May: There were 6,036 pending MDL dockets in the Paraquat Products Liability Litigation by May 1, 2025.
  • April: According to a court filing, Sygenta has entered into a settlement agreement with the plaintiffs' lead counsel. The Letter Agreement aims to settle thousands of paraquat lawsuits.

2024:

  • December: Out of the ten cases selected for potential bellwether trials in MDL 3004, six cases had already completed the limited case-specific discovery phase. On the other hand, paraquat cases filed in state courts encountered delays. Judge Charles Treat, who presides over Paraquat cases filed in California state courts, excluded Dr. Martin Wells from giving expert testimony. Dr. Wells was also barred from giving expert testimony in the MDL by Judge Rosenstengel, leading to the dismissal of the initial bellwether cases.
  • October: According to an order issued by Judge Rosenstengel, two individual lawsuits were selected to be part of 10 cases that would move forward to the discovery phase, after two plaintiffs backed out as potential bellwether cases.
  • September: A Colorado resident filed a lawsuit against Sygenta AG and Syngenta Crop Protection, LLC, alleging that his Parkinson's disease was caused by long-term paraquat exposure from the company's products.
  • April: Four cases potentially selected for bellwether trials were dismissed by summary judgment after the judge barred expert testimony from the plaintiffs' expert, Dr. Martin Wells.

2022:

  • June: The court postponed the first paraquat bellwether trial scheduled on November 15, 2022, due to the increasing number of paraquat cases.

2021:

  • June: The US Judicial Panel on Multidistrict Litigation created MDL No. 3004, or the Paraquat Products Liability Litigation, in the Southern District of Illinois. The MDL was presided over by Chief Judge Nancy J. Rosenstengel.
