Paraquat Facts & History

Plaintiffs who allege they've been diagnosed with Parkinson's disease after being exposed to Paraquat-based herbicides have asked the Joint Panel on Multidistrict Litigation (JPML) to merge their cases into a single federal court.

The request comes as the total number of federal lawsuits has raised to more than 20. Parkinson's patients exposed to Paraquat products like Gramoxone have filed similar cases in California, Illinois, Wisconsin, Arkansas, Maryland, Missouri, and West Virginia. As more people learn that their diagnosis could be related to Paraquat exposure, hundreds, if not thousands, more lawsuits are likely to be filed in the coming months and years.

Multidistrict litigation (MDL) groups the cases together to reduce overlap and expedite the process. There is no time to waste when it comes to a neurological disorder like Parkinson's. Multidistrict litigation's efficiencies reduce redundancy and provide individuals with the quickest path to justice.

PARAQUAT PRODUCTS LIABILITY LITIGATION, MDL NO. 3004

Location: Northern District of California

Presiding Judge: Judge Edward Chen

Plaintiffs: Farmers and agricultural workers

Defendants:

  • Syngenta (Gramoxone manufacturer)
  • Chevron Phillips Chemical Co. (CPChem)

Products: Paraquat products like Gramoxone

Plaintiff Allegations:

This litigation involves allegations that Paraquat applicators are developing Parkinson's disease after handling the herbicide, owing to the manufacturer's failure to include adequate warnings and safety instructions about the neurological risks which may result from the regular handling of the weed and grass killer.

History:

2021:

  • April:
    • In a lawsuit filed in the United States District Court for the Eastern District of Missouri, the Defendants named were Syngenta Corporation and Chevron Phillips Chemical Company LP. The Plaintiff alleged that Paraquat is unreasonably dangerous to human health and unfit to be marketed, particularly without adequate warnings and instructions about the dangers associated with exposure.
    • In a product liability case, a Missouri woman said she developed Parkinson's disease as a result of years of direct exposure to the herbicide while working with it and living on a farm where it was widely used.
    • A certified Paraquat applicator claimed in a lawsuit filed in the United States District Court for the District of California that he mixed and applied the pesticide for at least three decades, first working for a certified applicator, then getting the license himself, and that he nevertheless developed Parkinson's disease as a result of his exposure to Paraquat.
  • March:
    • A Tennessee man filed a lawsuit claiming that his Parkinson's disease was caused by his exposure to Paraquat while employed as a laborer and farmer in California in the 1980s.
    • Following his exposure to Paraquat, an Illinois man claimed in a lawsuit that he sustained serious neurological injuries associated with Parkinson's disease.
    • In a lawsuit filed in the United States District Court for the Southern District of Illinois by a man who said he developed Parkinson's disease after years of exposure to Paraquat-based herbicides, the Defendants named were Syngenta and Chevron USA.
    • Paraquat exposure caused Parkinson's disease, an Illinois woman alleges, after years of what she thought was safe use when mixing, packing, and spraying the herbicide on farms.
  • February:
    • An Illinois man claimed in a lawsuit that Paraquat exposure caused him to develop Parkinson's disease, saying that he used the toxic herbicide on a routine and regular basis for years before his diagnosis.
    • Syngenta, Chevron, and other herbicide manufacturers were sued for failing to reveal details about the correlation between Paraquat exposure and Parkinson's disease, according to a former crop duster who developed the neurological disorder after spraying the toxic weed and grass killer for years.
