Sunscreens with Cancer-Causing Benzene Facts & History

People who have been harmed by a benzene-contaminated sunscreen product can now be compensated for their pain and suffering. Anyone deemed eligible may receive compensation.

In May 2021, an independent lab and online pharmacy called Valisure made requests to the U.S Food and Drug Administration (FDA) through a citizen's petition, alleging it discovered higher than acceptable levels of benzene in 78 popular sunscreens produced by various manufacturers. Sunscreen is considered a drug product, which means that these companies must follow strict regulations set forth by our federal food and drug regulator.

Later, in July 2021, Johnson & Johnson recalled the following sunscreen products:

  • NEUTROGENA Beach Defense aerosol sunscreen
  • NEUTROGENA Cool Dry Sport aerosol sunscreen
  • NEUTROGENA Invisible Daily defense aerosol sunscreen
  • NEUTROGENA Ultra Sheer aerosol sunscreen
  • AVEENO Protect + Refresh aerosol sunscreen

In litigation of this nature, it is essential to know that there are potentially hundreds of thousands of plaintiffs who could join a federal MDL (multi-district litigation.) An MDL temporarily consolidates all similar cases into one federal court. But unlike class actions lawsuits, plaintiffs in an MDL remain separate from each other and cannot combine their resources or file joint complaints as they would if filing together.

  • May:
    • A proposed class-action suit was filed against Neutrogena and J&J in federal court. The lawsuit was Meredith Serota v. Neutrogena Corp. and Johnson & Johnson Consumer Companies. The case claims defendants broke federal and state laws by not listing benzene as an ingredient in sunscreen products. The class-action suit aims to cover anyone in the U.S. (other than California) who purchased one of the recalled products since May 25, 2017, even if they did not get sick.
  • July:
    • A similar class-action lawsuit was filed in a federal court in California: Johanna Dominguez and Sharron Meijer et al. v. Johnson & Johnson Consumer Inc.
    • A motion filed with the JPML seeks consolidation and centralization of the litigation in the District of New Jersey for pretrial proceedings for product liability lawsuits filed against J&J over recalled sunscreen products.
  • August:
    • A complaint was filed in New Jersey, presenting claims against J&J Consumer, Inc., for marketing their sunscreen products as a way to decrease the risk of skin cancer, without disclosing that they contain dangerous levels of the known carcinogen benzene.
